Registering Complaints or Problems

11/19/2008 - Today I received emails from three tenants concerning recent activity or problems that has concerned them, each indicating extreme displeasure and the possibility of moving out if things don't seem to improve. Though I really appreciate you emailing me with your concerns and comments so we can track things, I need to point out that each of you needs to report your concerns directly to the management office.

I have been told by Amanda, on more than one occasion, that nobody else has complained about some of these issues, implying that I am the only one. In a meeting with Amanda yesterday, I was told that she will no longer take or register complaints from other tenants through me. Therefore if you don't personally register your own concerns or complaints of persons breaking property rules or policies, nothing will get done to resolve them.

SWAT on Property

11/19/2008 - I had a couple of tenants ask me what this was all about. Jim Freed sent me an email making me aware of the situation. In talking with others and the office, this is what I have been able to piece together.

Late Wednesday, sometime between 3-pm and 5-pm, what appeared to be a local SWAT team, consisting of seven to eight persons, deployed on property around unit 311 in building three. Seems that they were here for nearly two hours. When Jim opened his door, he was told to go back inside his appartment and stay there. They also had an extra guard posted out in front of his porch. Jim said that they finally breached the apartment and went in, though he wasn't sure if anyone was home and didn't know whether any arrests were made or if they just missed
timed their raid. As to the "why" I do not know all details, however from what I've been told, it appears that our nighttime security person wrote up a report concerning the occupants of this unit that was forwarded to the police. The police then came and "evicted" the occupants from the property.

Drag Racing in Parking Lot

11/17/2008 - The residents of Unit #323 reported to me via email that they had just been involved in a very frightening incident. On Monday, at approximately 3:30 pm, they were attempting to back out from their parking space in front of Building three, when they heard a loud noise that sounded like an engine revving. They had just put the car into gear (reverse), when out of the blue, two cars, hidden from view because of the dumpster, raced side by side up the driveway towards the dumpster in front of Building 5. They reported that it was a miracle that they nor any other cars got hit. Because it happened so fast, and the fact that they were so upset, they did not even write down the plates &/or description of the cars.

Five Police Cars on Property @ 4:15am

11/15/2008 - Friday night (actually 4:15 am Sat morning) when I came home, I was nearly side-swipped in front of the mail box area by a white SUV, that entered the property and passed me doing at least 40 mph. I was so startled, I just sat there until he was out of site. I then followed after him and found a police car stopped between buildings #22 and 23, with the roof lights on (no lights were on when he went by me earlier). An officer was out of the car walking around with a flashlight.

I was later informed by Marc Resnick (#2322) that when he came in at just before 5:00 am, there was a police car on Green Valley Pkwy blocking the exit to the property, and four or five cars in the area of buildings 22 and 23, preventing him from parking his car in his assigned parking space. Anytime there is something that requires five or six police cars on property, I get very concerned.

When I got up I went to the office and asked Kristen is she was aware of the incident. She said she knew nothing about it, but would call the police and find out. On Monday, I emailed Amanda about this asking her if they had found anything out. I talked with her a couple of days later, and she told me that she knew nothing and if I wanted to know what it was about, that I should call the police department.

10/29/2008 - Phone Conversation with Bill Kerr

[I received this in an email from our friends and neighbors in building unit #323 and thought that it had to be posted that that others could see what we are sometimes up against in trying to get problems and issues resolved at time.]

RE: Regarding phone call with Bill Kerr on 10/29/08. Bill returned our phone call when we were trying to get a hold of Barbara. He is the Operations Director for Olen Properties and represented himself on Olen's behalf.

Regarding our complaints about the use of the tennis courts, he stated to us three times that if we wanted the tennis courts to be tennis courts, and didn't like what was going on, "that we could just move".

Even though we explained that professional tennis courts are the reason we rent here and that on 02/08, when we resigned our lease for the 5th time, Debbie Pinto promised us that the tennis courts would be just that and not be used as a playground, and wrote such into our lease. He then noted that he thought "we were being unreasonable" and that "we mean nothing to Olen as long term residents".

He then said, "You want preferential treatment". This was even more insulting. We only want an apartment with tennis courts that are properly taken care of and not subject to constant damage because the courts are being improperly used as a playground. We would not pay the rent we are paying for a playground or basketball court.

He then noted that the, "Amenities are not for the residents ... you do not pay rent for the amenities." Pardon us? Whom are they for? Again, we have always clearly stated that one of the main reasons we rent here is because we want to be able to play tennis. He then noted that, "Any day he could shut the courts down and turn them into a playground." At this point I became fully incensed. I have never been spoken to by anyone like this person spoke to me during this conversation.

We have always tried to be good neighbors and report destructive, obnoxious, dangerous and plan stupid behavior to the office. We are heartsick that one of our neighbors was hurt by rock throwing vandal. War games on property with paint guns, hitting off the ball machine with a metal bat towards the buildings, and using the tennis courts as a golf driving range, again towards the buildings is our definition of stupid behavior. Riding bikes, skateboards, and roller-blades, on the tennis courts, sidewalks, off steps, guard rails and in between cars makes us cringe. We have caught people stacking the pool furniture and using it as a diving board, and we put a stop to it immediately. Prostitution was reported and the person moved on. We reported a man who was pounding on his girlfriends door and making threats, to the office, and were told by Kristin that nine other residents had come to her office also concerned about the situation.

So, having never talked with Mr. Kerr at any time in the past, we are at a total loss for words as to why he talked to us in this manner.

In talking with some of my neighbors, we realized that we were paying one of the highest amounts. We were in the $1000.00 plus range, and most everyone else was not. We thought it was a simple mistake and easily rectified. Michele in your office told us it was just our bad luck and hung up on us. Again, we were offered the opportunity "to move" if we were unhappy. We are really getting annoyed with that! However, it was eventually resolved; and we thank-you.
However, for whatever reason, there seems to be a lot of anger directed at us.

It seems personal.

Boundry Fence between Property and Golf Course

10/05/2008 - On a walk around the property I found at least 7 areas where the steel bars were missing in the boundry fencing, making it easy for anyone to just walk through the fence. These areas definately need to be repaired.

This matter was discussed with Amanda in a meeting on 10/06.

Non Residents In Workout Building

10/05/2008 - During a walk around the property the evening of the 5th, I caught three kids leaving the workout room who, after seeing me, ran to their car and left the property. As I was walking from within the pool area I wasn't able to see them well enough to describe them. The car appeared to be a dark color, maybe black, with NV plate #28T1.

After describing the car, Tom thought he recognized the car and plate number and may have kicked them out on a prior occasion. After touring the facility we found trash inside, two light sticks, a cigarette lighter in the men's room and some weird slippery chemical spread on the tile floor in the men's room.

[The following is a copy of a letter written to management concerning problems with the tennis courts and children riding bikes and playing ball in and around the buildings, shrubs and parking areas.]

Subj: Issues with Mr. James Kenyon, Unit #511


Let me start by saying that the situation concerning Mr. James Kenyon of apartment #511 is getting completely out of hand and that managements’ failure to resolve the issues associated with this tenant by not evicting him is beyond me. The problems of him allowing his children to bounce basketballs, hit baseballs, and ride their bicycles on the tennis courts, as well as playing and throwing footballs and other objects in and around other tenants entranceways, walkways and parking areas has been going on since August. Myself, and several other tenants, have repeatedly voiced and filed complaints, not only against Mr. Kenyon, but others as well who have been violating Players Club policies. Apparently, management either has no control over the actions of tenants or doesn’t care about the concerns and satisfaction of its long-term residents. I know this letter appears lengthy, but please take the time to read it in its entirety.

This tenant’s blatant disregard for the rules and policies of the complex is only exacerbated by his rude and disrespectful confrontations with other tenants. The facts are that he has painstakingly sought to learn through direct confrontation, which person(s) have made complaints against him for his failure to adhere to the policies. In at least three of the instances where he has confronted other tenants asking, “have you been making complaints about me and my children?”, he has personally threatened the tenant, one being me, noting that he and his children will continue to do “and play anywhere they want” and that if we continue to complain, that he will, “file a harassment lawsuit against us.” On separate occasions, he personally told both myself, and the tenants in apartment #323, to “move if we didn’t like it.” Some of us have personally witnessed him talk disrespectfully to and threaten the management personnel, Amanda and Kristin, with the same language. Where does someone with a 6-month lease get off talking like that to tenants who have been here for nearly 6 years?

Well, maybe your employees have to put up with this type of behavior from a tenant, but the rest of us, many of which have been responsible tenants, abiding by the policies and paying rent on time for more than five years, should not have to put up with threatening behavior from any other tenant! It is to the point that my wife is afraid of this guy, and afraid that his behavior could turn to violent action against me or some other type of retaliation.

Just a few days ago [on 10/27/2008], after I had left the apartment for the evening, my wife witnessed him and his children bounce their basketballs down the sidewalk in front of our deck to the 6-foot cement pad in front of the east entrance gate to the tennis court, and then, not entering the court, stood there and had his kids bounce the balls for nearly 15-minutes. It was so obvious that this was being done as an act of direct “taunting” and harassment in retaliation for receiving a complaint notice, that my wife, who was home alone, became very nervous.

This was compounded by the fact that there have been two other occasions when he has had his kids out on the tennis court hitting baseballs or playing basketball, when he has walked back and forth along the fence looking up at our deck while we were sitting there having a cigarette, and another time when my wife was sitting alone on the deck with the slider open, that he stood there looking up calling out my name.

During the week of [10/19/2008], after the placement of a sign on the court entrance noting tennis court rules, there were at least three instances of him and his children using the tennis court for activities other than tennis. I know that I’m not the only tenant complaining about this to the office. On [10/25/2008] they were out on the court bouncing basketballs for about a half hour. After they left the tennis court, instead of heading toward their own unit, they started bouncing balls on the sidewalks next to buildings three and four. Once again, this action could only be construed as intentional taunting and harassment, knowing that he was having his kids do this directly in front of two units that he knew had filed complaints against him.

On [10/24/2008] I spoke to several children, not all of them belonged to Kenyon, who were running around and between buildings 3 and 4 and in and around the cars parked in front of building 4 throwing a football. As we have no children their age living in buildings 3 or 4, I told them to go play in front of their own building. The two oldest looked at me and just smirked. I waited for them to finally move to the next building, before going back inside. I eventually reported this to the office noting that I have seen them running in and out of the shrubs along the tennis court in front of my unit. Though generally, the property rules are lacking and vague on many issues, they are very specific concerning this behavior.

"For ... the respect of other residents, the following must be observed:
· Children should not play in or around parked cars, driveways, parking lots decorative landscaping such as trees or shrubs, dumpsters or other residents' apartment windows, entrance ways or gates.
· Toys and bicycles must not be left in driveways, parking lots, and sidewalks or in front of stairs.
· All toys must be of a type that does not make noise that would disturb other residents. Toys that may be thrown or flown shall not be used within the confines of the perimeter wall of the property.
· Bicycles, roller blades, roller skates and skateboards shall not be ridden on sidewalks in the property."

Mr. Kenyon’s direct response to property management on this matter, was again, “My kids can play anywhere they want.”

On [10/06/2008] I reported to the office that there were 6 kids not just riding bicycles on the sidewalk and grassed areas between buildings 23, 5, 4, and 3, but “racing” each other. A couple of times someone ran into shrubs due to a loss of control of their bikes. I spoke to the oldest and told here that they were not suppose to be riding on the walkways, and that she should so inform her parents. In reporting this, I noted to the manager that all these kids did not belong to Mr. Kenyon and described some of them as best I could in an effort to help her identify them. However, Mr. Kenyon stated to me on a later occasion, “that his kids can ride their bikes on the sidewalks if they want.”

On [09/23/2008] a woman was letting her two children ride around the tennis court on Big Wheels. This was the second time this happened and I reported it the first time to the office, noting that the mother appeared to be oriental.

It was noted in a meeting on the morning of [09/15/2008] with Amanda, the Property Manager, that Mr. Kenyon was allowing his children to run around playing and riding bicycles on the tennis court, even at times when others had been on the court trying to play tennis. I also noted that he had approached me on the sidewalk in front of my unit earlier in the morning and inquired if I was the one who was "calling the police on him." When I responded no, he then asked, "had I complained to management about his kids riding bikes and playing on the tennis court?" I noted that I had and began to explain why. I tried to explain that in the past we had had some real problems with the tennis court being used as a playground, that took us nearly six months to finally get resolved, and that the real problem was that when one resident sees another allowing their children to play on the court, then they in turn think it is alright for their children to do it as well.Mr. Kenyon then informed me, "that there was no rule or policy specifically stating that his kids couldn't ride their bikes on the court, and that he was only staying here for six more months and that he was going to continue to be out there with his kids and that I better get used to it." He also stated that they would also be riding on the sidewalks and parking areas if they wanted. I noted that he had presented this to me in a very personal and threatening manner, and that I wanted something done. Apparently this is acceptable behavior, as he threatened another tenant, as well as a property employee, just this past week, apparently without any retribution.

On [09/08/2008] I noted to Amanda that since August, there have been numerous instances of persons using the tennis courts as a play area for their children. In the beginning, we let this slide a little, hoping that it might not become a regular occurrence, however, that proved to be wrong. I noted that there was more than one family letting their children use the court for riding bicycles and big wheels and that just last night [09/07/2008] there were two different families that were riding bikes on the courts at different times. I emphasized that we went through this problem for nearly 6-months the first year we were here and certainly did not want to have to go through it again. I received an email from Amanda noting that they knew who was doing this and that the problem “has been taken care of.” Well, since they were out there the next night after I received her email, and that it still continues to be a problem to this day, I guess it still hasn’t been taken care of.

In summary, it’s not bad enough that you not only treat your long term residents with less respect than newer residents with short term leases, but continue to charge us more as well. We are paying $1,000.00 a month for an apartment that is nearly 18 years old with outdated kitchens, flooring and carpet, while some newer residents are getting fixed up units, getting “move in” breaks and paying far less.

As you can see from the aforementioned, that we have in no way “singled out” Mr. Kenyon, even though he seems to be the primary offender and cause of recent problems, but reported on other violators as well. He has even gone so far as to bring some of his neighbor’s kids out on the courts with his, in the hopes of trying to garner more support for his continued behavior and total disregard for the properties’ policies.

The primary reason many of us chose this property if for the recreation amities that The Players Club advertises such as, “A Sparkling Pool, Indoor and Outdoor Spas, Sauna, 2,000 sq ft Fitness Center, Aerobic Studio, Sand Volleyball Court, and Lighted Tennis Courts”. Not only is that what we signed up for, many of us paid a higher rents for units that supposedly have a “pool view”, easy availability to the tennis courts, etc. If we thought we would be living next to a playground, we never would have rented the units we are in. If someone wanted basketball courts, bike riding paths and a playground for their children, they should have looked elsewhere.

Someone needs to explain to us why management has been unable to get Mr. Kenyon to abide by the rules and policies of the Players Club and why, when he has clearly demonstrated harassing and threatening behavior toward other tenants, that he hasn’t be evicted from the premises. We would appreciate a face-to-face with someone in upper management explaining what steps are going to be taken to correct these issues.

Playing Around Shrubs, Cars and Buildings

10/24/2008 - I spoke to several children who were running around and between the parking areas in front of buildings four and five throwing a football. I told them to go play in front of their own building. The policies are very specific concerning this.

Basketball on Tennis Court and Sidewalks

10/25/2008 - For about the third time in the past week, our favorite tenant had his kids in the tennis court bouncing basket balls for about a half hour. After they left the tennis court, they started bouncing balls on the sidewalks next to buildings three and four. These actions have been reported to the office at least three times in the past couple of weeks. Today, when confronted, he was rude and disrespectful to both Kristin and made verbal threats to the tenants in building three. This is not the first time he has threatened a tenant. This needs to STOP NOW.

10/27/2008 Update - Last night, about 6:30, the gentleman from unit 511 had his kids bouncing basketballs on the cement pad directly in front of the gate where the new sign is on the tennis court, directly opposite the girls' unit who had confronted him this past weekend. This had to be nothing but pure harassment. We really need to do something about this guy!

10/28/2008 Update - He and his wife were out playing tennis while their two children were bouncing their basketballs. [10/28 - Had a brief meeting with Amanda and Kristin this morning over this subject. She said she would ask the night security person to patrol past the tennis courts every half hour during the early part of his shift.]


11/03/2008 Update - Barb Stidd, VP Olen Properties, has informed a couple of us who have been trying to get management to enforce their policies concerning the use of the tennis courts and the bouncing and throwing of basketballs and footballs on sidewalks and around the parking areas, they are going to divide the tennis court in half and turn one of the two existing courts into a basketball court. She had directed our property manager, Amanda, to have no further discussions with tenants concerning these matters, and that all future discussions, complaints, or issues relating to these matters by tenants be directed to her.

11/12/2008 Update - I went to the office and asked Amanda if the tennis court area was now considered a playground? At first, she told me that the area was now a tennis court and basketball court. I said that last Friday there were kids riding scooters on the sidewalks outside the court and that yesterday there were 5 children playing football and running around the court chasing each other, all who were under 18 and had no adult supervision. I asked if this was now acceptable in the tennis court, especially smaller children without adult supervision. Amanda stated point blank that it was. I asked when they were going to begin construction to change the area and she stated that she thought maybe by the end of the week.

I asked how they could do this without notifying tenants and specifically proposing to change the rules and policies that are part of our lease agreements that everyone has signed. She had no answer to this question and just shrugged her shoulders. This ridiculous action, combined with unprofessional responses to the legitimate complaints presented by responsible long term residents is beyond belief. Management's failure to properly deal with this situation boarders on negligence and malfeasance and is causing many long term residents to consider leaving the property. Some complaining residents have actually been told, "If you don't like it, why don't you just move", and to encourage them to do so have actually been told that management will let them out of their leases and refund any monies due as a result of prepaid rent.

11/18/2008 Latest Update - I guess the taking down of the tennis net, removal of the net poles and the jack hemmering and digging of two big hold on each end of the court for the placement of two basket ball hoop posts is evidence enough that manaegement has subcummed to the whims of one short term tenant regardless of the effect this will have on the other tenants, many who have been here for more than 6 years.

Bicycle Riding on Sidwalks

Burned out Lights

10/05/2008 - I did a walk around the property between 9:15 and 10:30 pm. I found at least 27 lights burned out. In addition, there are dozens that are filled with bugs, dirty and need cleaning out in order to provide effective lighting.

Meeting with Management Over Security Issues

10/06/2008 Notes of meeting with the property manager, Amanda, Ken Clarke, and Martin Wilson.

Security Issues:

Violated Units: We told Amanda that we were aware of at least two more incidents of rocks being thrown thru the windows of resident units and asked exactly what the current total was. Amanda refused to provide us any information regarding affected units, the times or dates of the incidents, or any other information, even in general terms. We provided her with observations of suspicious activity we had both personally witnessed and provided information and general descriptions of the persons involved.

Damaged Motor Vehicles: We noted that we were aware of two recent incidents involving broken windshields and windows to resident motor vehicles (bringing the total that we were now aware of to three), not including an incident that involved the burning of a motorcycle. She admitted that she was aware of the recent window smashing of two cars, but was unaware of the motorcycle incident, noting that it was never reported. Again she refused to provide information regarding the times or dates.

When asked if each of these incidents had been reported to the Henderson Police Department, she responded by noting, she had talked with the police and was told that if a resident calls and reports and incident, they will respond and write it up, however, if the property management calls to report a problem, they basically can't help. We found this to be very disconcerting, and plan on doing a followup with the local police.

We pointed out that we were aware of the fact that some residents have moved as a direct result of the recent escalation in vandalism and possible break-ins and that there were now quite a few of us who were getting very worried and concerned that the problem was getting out of hand and not receiving enough attention from corporate management. We demanded that management hire some nighttime security until the perpetrators were caught.

Faulty, Broken, Burned Out, Dirty Lights: She noted that she had received my email concerning the nearly 30 lights that were currently burned out or not working on the property and that they would see that they got replaced and/or repaired immediately. I continued to point out that there were many that I did not place on the list that were so dirty or filled with bugs, that their effect was negligible, and that what really needed to be done was a building-to-building approach to clean, repair or replace as needed. It was further noted that there were many rather large spaces within the property that were very dark at night and that someone needed to develop a long term plan to add more lighting to these area.

Fitness Center Security: I asked her if Tom had related the problem of last night at the fitness facility, and she noted she was aware. I noted that it seemed that maybe they should dead-bolt the entry door outside of the fenced area, to act as an additional deterrent to non-residents sneaking in and using the facility. She noted that this had been done once, and because several residents complained about the inconvenience, she was told by upper management to stop doing it. We pointed out that the security issue seemed to far outweigh the minor inconvenience of residents and that this was ridiculous.

Management's Failure to Inform Residents of Security Related Problems: We noted that even if we were able to form a "Community Watch Group", that it could not be truly effective if we could not rely upon property management to communicate problems and information and to support it. We noted that we wanted to help, but that right now management's position is not to provide us with information that may help us, as residents, to help you. She said she thought this might be a good idea, but that she could not provide us with information relative to reported issues.

Needed Repairs to Boundary Fence with Legacy: It was pointed out that there were at least seven areas along the fence line that were missing bars, allowing persons to enter and leave the property from the golf course, and that we were personally aware that on at least two of the occasions when rocks were thrown through unit windows, this is exactly what had happened, making it even harder to chase down perpetrators because they has so many easy escape routes. We noted that these openings were a security issue that was putting residents further at risk and requested that these be repaired immediately. She noted that previous negotiations with the Legacy Golf Course over replacing the fence had broken down, even after Olen offered to pay half the costs. However, she indicated that she could see no reason why Players Club couldn't repair the damaged areas and that she would look into what it would take.

We then requested updates on the following outstanding issues:

Tennis Court Signs - We were told that they should be installed by this 10/10.
Rules Change re: Tennis Court - We were told that the signs were being done "instead of" making a change to the rules. I noted that this is not what I was told by her on 9/19.
Repair of Inside Spa - We were told that this was "on hold." That they needed to install some new drains and still needed a thermostat to regulate the water temp, but that it should be completed by 12/4.
Heating of the Pool & Fixing of Burned Out Light - We were told that the light was on order and that they were going to begin heating the pool this week.
Repair of Chained Pool Gate - It was noted that this repair was tied to the installation of a "911 Phone" that was to be installed inside the pool area and that this also would probably be done by 12/4.

There was general discussion on some other areas such as some damaged locks that needed replacing, pruning of trees, landscaping, partial zero scape, people speeding in the driveways and other general matters.

Amanda agreed to provide written email response to the repair of the boundary fencing, and the fitness facility security issues, and to set us up with a meeting with Barbara so we could further discuss security and some of these unresolved issues.

Bouncing Basketballs on the Tennis Court

[I received this complaint from the Mark Resnick in Unit 2322]

10/31/2008 - I work nights and come home late and often don't get to bed until 5 or 6am in the morning. Today I was awakened by kids bouncing basketballs on the tennis court. I have lived here for more than a year now and have really enjoyed my experience at Player's so far. Even though this is not the first time that kids playing on the tennis court have awoken me, it is the first time I have complained. I don't understand why this is happening, as your rules policies state, "All toys must be of a type that does not make noise that would disturb other residents. Toys that may be thrown or flown shall not be used within the confines of the perimeter wall of the property." It was so annoying that I could not go back to sleep. Later when I tried to take a "nap" before work, they were out there again hollering and playing football. I don't think anyone is aware of how much louder bouncing a couple of basketballs are versus the gentle "ping - pong" of a tennis ball. I certainly hope these tenants get spoken to and that this gets resolved shortly. I reported this to the office staff when I paid my rent.

Big Wheels on Tennis Court

09/23/2008 - Though not reported to the office, it was reported here that a woman was letting her two children ride around the tennis court on their Big Wheels. This has been reported in the past, but we are not sure what unit the offender lives in. If anyone knows, please email us and we will pass it on to the office so they can be notified.
Update 10/08/2008 [In response to complaints about children using the tennis court as a playground, riding biycles and big wheels, etc., management placed a sign on the entry door of the courts indicating general property policies for use of this area including specifically, no bike riding, skateboarding or rollar blading.]

Cleanliness of Pool Area

09/23/2008 - At abut 10:30 am, after the maintenance personnel had worked the pool area, I brought Amanda out and walked the apron of the pool pointing out drink containers, beer cans, cigarette butts, and trash that was strewn about the area, noting that maintenance only seems to "clean the pool" and never seems to clean up these things, put back and arrange chairs, etc. I noted that a couple of days ago, I found glass around the spa that no one had bothered to remove, and that I should not have to come out here every morning and "pick up." The dirty condition of the spa was also noted. She agreed with me and said that she would speak to Jerry and him them come out and clean the area.
[Update 09/24/2008 - Maintenance came out within the hour and cleaned around the area, however the spa water still appears cloudy and dirty for the third day]
[Update 10/26/2008 - Even though maintenance does not empty the trash cans anywhere near as needed, nor do they ever clean or arrange pool chairs, I'm moving this to the Resolved Issues/Problems list]

Meeting w/Property Manager on Security Issues

On the morning of 09/15/08, Kenneth Clarke met with Amanda, the Property Manager to discuss the issues surrounding recent vandalism and or attempted break-ins.

It was noted that not only my wife and I, but several other residents who were aware of these incidents were becoming extremely concerned about our personal safety and wanted to know what measures management was taking to protect our property and safety.

I asked her what their investigations concerning the wave of unit window smashing's had come up with. I was told that they had determined who the persons were who were guilty of throwing the cement blocks thru the two dining room windows of Michael's unit; that they had in fact been children of property residents, and that they have since been evicted. When asked if they were able to tie these persons to either previous or subsequent incidents, she indicated that they had been unable to do so.

In discussing the most recent incident with Unit 412 this past weekend, she noted that the answering service never called her or the on-duty maintenance person at the time the incident was reported and that she was appalled that the police never came out to the property when called and actually responded back by phone to the occupants that they were too busy to come.
She stated that just last week, a Samual Avila-Bustillos of the North Area Command, [702-267-4572][email-problemsapts.cityofhenderson.com] was in her office for nearly an hour explaining how the police were going to become more responsive to such calls.

She indicated that she was scheduled to meet later that morning with Debbie Pinto, the District Manager, [702-251-3106][email-dpinto@oleanproperties.com], to present her with all the supporting information and documentation of reported incidents involving vandalism and attempted break-ins since her hire, and that Debbie would then be forwarding the information to Barbara [702 221-7684], the company Vice President for action.

I requested and received confirmation that she would address the following:
* the need for an on-site security person.
* the possibility of installing security cameras in appropriate locations
* the need to send a letter to all tenants re: these security issues and requesting their help in tracking down the perpetrators
* the need for an enclosed, lockable bulletin board to provide residents status updates concerning reported issues, problems, and their pending resolutions.

I was told that she would respond back to me directly as to upper managements decisions on each of these items. These notes were emailed to Amanda on 9/16/08.

1. Stop in at the Management office and report it to one of the staff.
2. Go to the Players Club website [Players Club Apartments], click on "Resident Services" and register to send an email directly to the Property Manager.

Things you should do when reporting a problem:

1. Document it by recording the following information

  • Note the date reported
  • Get the name of the person to whom you reported the problem
  • State the specifics of the problem

Meeting with Management over Tennis Court Issues

In a meeting on the morning of 09/15/08 with Amanda, the Property Manager, the issue of kids playing on the tennis court was also discussed. It was pointed out that the resident who was allowing his children to run around playing and riding bicycles, even at times when others had been on the court trying to play tennis, had approached me on the sidewalk and inquired if I was the one who was "calling the police on him." When I responded no, he then asked, "had I complained to management about his kids riding bikes and playing on the tennis court." I noted that I had and began to explain why. I tried to explain that in the past we had had some real problems with the tennis court being used as a playground, that took us nearly six months to finally get resolved, and that the real problem was that when one resident sees another allowing their children to play on the court, that they in turn think it is alright for them to do it as well.

He then informed me, "that there was no rule or policy specifically stating that his kids couldn't ride their bikes on the court, and that he was only staying here for six more months and that he was going to continue to be out there with his kids and that I better get used to it." He also stated that they would also be riding on the sidewalks and parking areas if they wanted. I noted that he had presented to me in a threatening manner, and that I wanted something done. Amanda noted that she knew who this person was and that letters had been sent explaining that the tennis court was to be used for tennis only, and that she would follow this incident up with another letter to act as a final warning.

I noted that he was right concerning the fact that there was nothing specific in the policies about not riding bikes, etc. in the courts and that we had suggested in the past that they add an addendum to the rules and policies to the effect to make it more clear to persons who were apparently unable to apply "common sense" to the issue.

I then asked her to please suggest to upper management that they add something to the policies to this effect at her upcoming meeting with Debbie Pinto and she said she would do so. These notes were emailed to Amanda on 9/16/08.

[I received word from Amanda that management was going to have some signs made up concerning the proper use of the tennis court and have them placed on each of the entrances. It was also noted that the offending resident that had approached me would be dealt with directly by Barbara, the company Vice President.]

[A sign indicating the property rule and policies for the tennis courts were posted on the entryway today. In addition the issue with the primary offending party has been resolved. However, she noted in our meeting on 10/06 that the placement of the sign was going to be in lieu of a change to the Property policies.]

[It appears that the issues with the tenant in 511 have not been resolved as of yet, however we, and property management, are still working on getting these issues resolved..]

Poolhouse Bathroom Door

09/13/2008 - I reported to both Jerry and Tom that the lock on the door to the men's bathroom was not working and in need of repair. [I followed this up with the office 3-4 days later, as it still had not been fixed. This item was repaired as of the last time I used the facilities, however, I don't know exactly when as no one ever got back to me regarding it.]

Reader Comment: Right after I moved in, the Management said we could put in direct T.V. About 1 week later, Amanda said that they had decided to go ahead and put antennas on each apartment building so we could all have have a chance to get the service. Then it was noted that the company was finishing up on Horizon Ridge Apartments and that in July they were going to have to have a large pool party to take orders. Why, this still hasn't been accomplished, I do not know. Currently, the service is not available to anyone with a north facing apartment. Improper Use of Tennis Court

09/08/2008 - [Reported this via e-mail on the property website] In recent weeks, there have been more than one family letting their children use the tennis court for riding biycles and big wheels. There were two occurances of this happening last night. We went through this problem the first year we moved in here, which seemed to take months to resolve. Would like management to put out a notice or letter to residents that this is not a playground and is to be used for tennis only.

RESPONSE: I received the following e-mail on 09/08: "I wanted to let you know that I have been informed of who is allowing their kids to ride bikes on the tennis court and it has been taken care of." However, since there were two occurrences again just last night, I don't think this issue has been resolved.

Clogged Shower Head in Master Bath

09/05/2008 - Connie reported to the girl in the office that the shower head in the master bathroom was clogged up so bad that was getting difficult to get enough water to come out for a shower. It was noted that it would be put on a schedule to be fixed. [This item was corrected on 9/11/08. Management's response to this matter was quick and efficient and was only delayed as a result of our not being available when they kept calling. They ended up repairing the spout nozzle, lubricating the on/off controls and replacing the shower head itself.]

Outside Spa Temperature

09/05/2008 - I reported to both property maintenance persons that the temperature of the outside spa was, again for the second or third day, well below normal, making it unfit for use. Tom came out and took the temperature which showed below 90-degrees. He noted that it was not something that they could fix and that they would have to call the head of property maintenance to come and fix it. When questioned about the inside spa, it was noted that there had been a problem with the heater; that it had been replaced and that they were still having problems with it maintaining the proper temperature. [The fact that this has not been resolved was followed up with an e-mail on the property website on 09/08] [Latest Update - 09/11 -I have been informed that over the past two days three new pumps were installed, one each for the spas and one for the pool. Lack of Spa Cleanliness

On 8/21 I asked why the outside spa was out of order again. I was told that it was a pump problem again. I then asked why the inside spa had an "out of order" sign on it. I was told that it was because it was too hot and that they didn't know why? I then noted that the inside surfaces of each of the spas were in need of cleaning. I was told that they were short on help and that it should be taken care of next week after the hiring of another maintenance supervisor.
09/01/2008 Update [I have been informed that over the past two days three new pumps were installed, one each for the spas and one for the pool. It is hopeful that the outside spa will be cleaned and ready for full use within the next couple of days. However, they are looking at resurfacing the inside spa which could take several more weeks.]
09/11/2008 Update [Outside spa back to normal - Inside spa still out of service]
09/22/2008 Update [Outside spa water dirty. It appears that maintaining this is a continuous problem for some reason. Basically not usable for three days]

Whether it was the Mediterranean style architecture and layout of the units, the views of the Legacy golf course, the fitness center, the beautifully landscaped pool, or all of these features, each resident has a favorite that is pivotal to their daily living experience and continued satisfaction. Coming from New England, for us it was the pool and property landscaping and maintenance that impressed us the most. Based upon their policy statement ...

... management obviously recognizes that their attention to each of these items is key to customer satisfaction and continued lease renewals. However, because management can't be everywhere at all times, it is up to us, as residents, to provide assistance by pointing out problems and concerns as we become aware of them. If you are privy to persons breaking or violating any of our community policies, you should not hesitate to bring it to the attention of management.

NEW RESTAURANT RECOMMENDATION: This used to be the "Red Rock Chili" restaurant. Now it is even better. Not only does it still offer great chili, it has excellent ribs. Plus they offer delivery, though, because it is just a matter of 5 minutes away, I usually go over and order directly. Oh Happy Days!

11/03/2008 Latest Update to the issues of playing basketball on the tennis courts:

Barb Stidd, VP Olen Properties, has informed a couple of us who have been trying to get management to enforce their policies concerning the use of the tennis courts and the bouncing and throwing of basketballs and footballs on sidewalks and around the parking areas, that they are going to divide the tennis court in half and turn one of the two existing courts into a basketball court. She had directed our property manager, Amanda, to have no further discussions with tenants concerning these matters, and that all future discussions, complaints, or issues relating to these matters by tenants be directed to her.

This will become a "huge" noise factor for all residents that live in close proximity to the tennis courts. This will now open up the use to all in the complex meaning you could have adults out playing in teams at all hours. Remember that the area is lighted and available to residents 24 hour a day.

All this because someone at corporate is apparently not capable of dealing with tenants who are currently breaking policies, which they have signed and agreed to follow. I don't know about you, but I just don't get it.

Good news! I have received word that starting tonight there will be a full-time security person walking the premises between the hours of 7:00 pm and 3:00 am. I have also been told that management will be reviewing the property looking for areas that may be in need of increased or additional lighting.

I have just learned that there have been at least 4-5 other malicious acts or attempted burglaries that have included the smashing of unit windows and the windows on two cars within the past two weeks. I will provide more when I get more info. This was verified by the property manager even though she would not provide us with specific details. Another malicious act or attempted burgulary occurred on Friday, [09/12/2008] at approximately 9:00 pm. Someone threw a large rock through the deck slider of Unit #412. [Click here to read more] This is the third such occurance in less than two months. If anyone has knowledge of who the perpertrators might be, please contact the management office immediately. All residents need to be extremely alert to persons roaming the property who either look like they don't belong or look suspicous. I will provide more information as soon as I have a chance to talk with management on Monday.

3rd Attempted Break-In

09/12/2008 - The residents of Unit 412 reported that at approximately 9:00 pm someone threw a large rock through their deck slider which smashed the screen, the slider, damaged the draw curtain and struck one of the occupants in the back while they were sitting on their couch. It was noted in a letter to management that two calls were made to the local police who failed to respond to the property. The police called back noting that they were "too busy" to respond. [P.S. Since the middle of July there has been at least two attempted burglaries to units along the golf course which ended up with each unit receiving broken windows. In each instance the perpetrators threw a cement block thru windows and then waited to see if it aroused someone inside. I know that the police were called in for the second incident which occurred around 11:00 pm., but were unable to find the perpetrators. After the police left, the unit resident found two persons walking along the golf course wall and asked them why they were there, after which they ran away. Inside Spa Temperature

08/27/2008 - One of the residents told both of the maintenance persons that the temperature of the inside spa was 120-degrees. They indicated that they had been having problems keeping the temperature regulated and would again place an "out of order" sign on it until they could take another look at it.
09/03/2008 Update - [We were told on September 3rd that a new heater or thermostat was installed and that they were now having trouble getting the temperature over 95-degrees. The fact that this has not be resolved was followed up with an e-mail on the property website on 09/08]
10/06/2008 Update - [In a meeting with Amanda on 10/06, it was confirmed that the inside spa would be out of commission until at least 12/04 due to planned repairs. It was noted new drains were needed in addition to a new thermostat that was on order. Based upon this information, this will be approximately 15 weeks that this will have been out of order and unavailable to resident use.]
11/07/2008 Latest Update - [As for now the inside spa is now fully functioning, however it is unclear as to whether it will be shut down again for some cleaning and resurfacing]

Site Overview

Though we have been residents of the Players Club for over five years now and know of several neighbors who have lived here much longer, the one thing we are sure each of us has in common, as the sign on the front of the property states, is that these are our homes, and as such, we expect management to maintain them as we would if we were the owners.

Unfortunately, in the relatively short time we have lived here, we have seen crime go up in our neighborhood and many property services either eliminated or go down hill.
